Terms of Service
These Terms of Service ("Terms") govern your use of the services provided by Smog Check Network ("Network") as well as any associated websites, applications, platforms, and communication channels (collectively referred to as the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you may not use the Service.
1. Description of Service
The Network provides a platform that connects vehicle owners in need of smog check services ("Customers") with certified smog check stations ("Smog Shops") within the Network's network. The Network facilitates the scheduling of appointments, processing of payments, and other related services to streamline the smog check process.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
3. User Accounts
In order to access certain features of the Service, you may be required to create a user account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account.
4. Service Fees
The Network may charge fees for the use of certain features or services provided through the Service. By using such features or services, you agree to pay any applicable fees as described on the Service. All fees are non-refundable unless otherwise stated.
5. Disclaimer of Warranty
The Service is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. The Network makes no representations or warranties regarding the accuracy, completeness, reliability, or availability of the Service.
6. Limitation of Liability
To the fullest extent permitted by applicable law, the Network shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; or (iv) unauthorized access, use, or alteration of your transmissions or content.
7. Indemnification
You agree to indemnify, defend, and hold harmless the Network, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your use or misuse of the Service, your violation of these Terms, or your violation of any rights of a third party.

8. Modifications to Terms
The Network reserves the right to modify or revise these Terms at any time, in its sole discretion. Any such changes will be effective immediately upon posting the revised Terms on the Service. Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

These Terms shall be governed by and construed in accordance with the laws of California, U.S.A., without regard to its conflict of law principles.

11. Communication Disclosure
By accepting this terms of service you agree to potentially receive recurring informational SMS, MMS or Email messages from Smog Check Network. My click is my electronic signature, and I authorize you to send me text messages on my mobile phone or landline. I understand that consenting to receive SMS messages is not a condition of purchase or service. This is a standard rate subscription service available on most carriers, Msg & Data Rates May Apply. You can also request additional information by texting HELP or sending an email to info@smogchecknetwork.com. Service will continue until customer cancels. Messaging frequency will vary. Subscription may be canceled by texting STOP.
